This website is operated by Funding Wine Services and the following Terms and Conditions apply.

These terms and conditions are an agreement between the customer ("You") and Funding Wine Services (BN9835800).

Persons under eighteen (18) years of age are not permitted to place orders for alcohol.

Under the NSW Liquor Act (1982) it is an offence to sell or supply to or to obtain liquor on behalf of a person under the age of 18 years.

Other states have similar laws and you must provide your date of birth when ordering to confirm that you are over 18.

If you are buying a case of wine as a gift, the recipient must also be over eighteen (18) of age.

The terms and conditions under which You may purchase wine through Funding Wine Services are set out below.

Please read the following terms and conditions carefully before placing Your order.

By completing the order process and using the Fuzzy Ball Wines website, You acknowledge that You have read, understood and agree to be bound by these terms and conditions.

Modification of these Terms of Use

Funding Wine Services may add to, delete, or otherwise change any of the terms, conditions, and notices under which the Fuzzy Ball Wines website is offered. Your use of the Fuzzy Ball Wines website will constitute Your deemed acceptance of such changes.

Prices

All prices are quoted in Australian Dollars (AUD) and include Goods and Services Tax (GST). Unless specified, any delivery charges are included. While we shall endeavour to keep pricing current at all times, pricing may be subject to change without notice.

Availability

Wine is an agricultural product and runs out from time to time. All orders and offers are subject to availability of stock. When ordering, if any items requested have sold out You will be notified.

Ordering Your Goods

Wine deliveries can only be made within Australia.

Under the various liquor and licensing laws of the states and territories of Australia it is an offence to supply alcohol to a person under the age of eighteen (18) years, and it is an offence for a person under the age of eighteen (18) years to purchase or receive liquor. Funding Wine Services and all wineries presume that anyone at the Delivery Address who receives the wine is authorised to receive the Goods on Your behalf.

All orders are processed and distributed from the licensed premises of the various wineries listed.

Funding Wine Services and all wineries shall not be liable for any delay in delivering Your goods if that delay or failure is caused by circumstances beyond their control such as war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or act of God, failure of Internet Service Provider (ISP) or telecommunications provider.

Funding Wine Services is not responsible for wine quality, packaging or bottling of wine as these matters are the responsibility of the Winery. To the extent permitted by law, You release Funding Wine Services from any claim or liability in respect of quality, packaging, bottling, usage, consumption or handling or wine.

Funding Wine Services and all wineries shall not be liable for or responsible for any incorrect addressing /delivery details provided by the customer.

The shopping cart section of the Fuzzy Ball Wines website lists the wines that can be ordered from the various wineries. Please note You may submit an order to more than one Winery but as the wine is delivered directly from the wineries, You will receive Your wine from each winery separately.

Payment

The contract of sale of wine is between Yourself and the winery, and not with Funding Wine Services, therefore Your credit card will be debited by each winery that You order from.

Details of Your order, contact details and delivery instructions will not be given to anyone except the Winery with which the order is placed.

Funding Wine Services and all wineries reserve the right to cancel any order, at which time we will immediately notify You of this action by e-mail or phone, using the e-mail address or number/s You provide. You will be refunded the monies paid using the original method received.

Funding Wine Services and the wineries take reasonable steps to verify that the order and credit details are bona fide.

Delivery

In most cases delivery should be within 5 working days, however in some instances please allow up to 10 business days.

As minors are legally unable to place orders or receive wine deliveries, please ensure that the person receiving the delivery is over the age of 18 years.

All deliveries are made during business hours. Please provide a delivery address where deliveries can be personally accepted and signed for. If at the time of delivery there is no one available to accept delivery, a card will be left in the letterbox advising delivery contact details. If the carrier is Australia Post, your wines will be available for pick up at your local post office.

Some parts of Australia are designated as "dry communities" which means that the consumption and supply of alcohol is strictly forbidden. Wines will not be delivered to such areas under any circumstances.

Returns

The Winery is responsible for wine quality however Funding Wine Services will facilitate the handling of customer service issues.

If at any time You are not satisfied with the quality of the wine or if Your wine is suffering from a wine fault and does not meet the high standard You expect, please contact us, and we will facilitate Your request for a refund or replace the wine, as soon as we have collected the rest of the wine from You and it is received back at the winery, and provided You have only opened two (2) bottles or less.

Customer Satisfaction

If You are dissatisfied with our performance in any way, please contact us. At Funding Wine Services, we aim to deal with all enquiries fairly, confidentially and quickly. We will acknowledge Your contact as soon as possible. We endeavour to resolve most issues immediately; however, where this is not possible, we will keep You informed about progress until a satisfactory resolution has been achieved.

We are continually improving our service so if You have any suggestions or feedback about how we can improve or service, please email us.

Packaging & Labelling of Goods

Funding Wine Services aims to include in the online shopping cart Product List, up-to-date pictures of the Goods. At times, the pictures of the Goods on the Product List are for illustrative purposes only. Funding Wine Services does not warrant the accuracy of information contained on the Product List and recommends that You read the label on the actual Goods carefully before consuming the Goods.

Security

Funding Wine Services are conscious of the security of customer's information.

This website has protections to ensure that all orders are secure, our website supports Secured Sockets Layer (SSL) based transactions of 128 bit or greater.

Copyright & Trademark Notices

This website and its contents are subject to copyright. The site material copyright is owned by Funding Wine Services, or in the case of our contractors and suppliers who have contributed to the content of this site, a third party. The site function and operation copyright is owned by Funding Wine Services.

Viruses

Whilst we take every precaution with the files we make available on this website we cannot guarantee that any file or program available for download and/or execution from or via this site is free from viruses or other conditions, which could damage or interfere with data, hardware or software with which it might be used. Protection from such malicious or destructive content remains Your responsibility. You assume all risk of use of all programs and files on this site, and You release Funding Wine Services and all wineries entirely of all responsibility for any consequences of its use.

Third Party Sites

In an attempt to provide increased value to our visitors, Funding Wine Services may choose various third party web sites to link to from its own site. However, even if the third party is affiliated with Funding Wine Services, we have no control over and accept no responsibility for the content or use of these linked sites. You acknowledge that Funding Wine Services has no control over the content on external sites we may link to, which is subject to that third party's terms and conditions of use.

Jurisdiction

The use of this website shall be governed by and construed in accordance with the law of the time being in force in the State of New South Wales, Australia and the parties irrevocably submit to the jurisdiction of the Courts of that State including any Courts having appellant jurisdiction.

This site may be accessed throughout Australia and overseas. Funding Wine Services makes no representations that the content of this site complies with the laws (including intellectual property laws) of any country outside Australia. If You access this site from outside Australia, You do so at Your own risk and are responsible for complying with the laws in the place where You access the site.

Privacy

All information supplied by You will only be used by Funding Wine Services and all wineries for the supply of any wine that You may purchase or to notify You of future Funding Wine Services activities, promotions and specials that You may be interested in. Your privacy is important and Your details will NOT be passed on to any other party or be used for any other purpose.

Launch Competition Terms and Conditions

Competition description - Win 60 bottles of wine, a wine lovers weekend away and $5000 cash for your tennis club.
Individual winner prize - 60 bottles of wine, a wine lovers weekend away.
Winning tennis club prize - $5000 cash.
The individual winner must be 18 years of age or over.
The individual winner must purchase a minimum of one case of wine through this website.
The individual winner must reside in Australia.
The individual winner shall be notified by telephone between April 1 and April 9.
The winning club shall be notified by telephone between April 1 and April 9.
A minimum of 350 cases of wine must be purchased through this website as a result of this promotion prior to midnight on March 31, 2010.
Should 350 cases of wine not be purchased through this website as a result of this promotion prior to midnight on March 31, 2010 the competition shall be voided and no individual or club shall be eligible to receive prizes.
